The New York and New Jersey law offices of Levy Phillips & Konigsberg, LLP, experienced with
mesothelioma lawsuits, are pleased to announce that the firm has obtained a multi-million dollar settlement for a New York mesothelioma victim. He was exposed to Asbestos in Pennsylvania while working as a ship builder and, later, as a construction worker. Although it began in Pennsylvania, this Asbestos legal case was fought in New York courts.
The client was diagnosed with mesothelioma at the age of seventy-nine while living in Westchester County, New York. His first
exposure to Asbestos began in 1941 while employed as a pipe-fitter's helper at the Sun Shipbuilding Pennsylvania Shipyard in Chester, Pennsylvania. During his apprenticeship, he installed and maintained the piping systems onboard several ships. Thereafter, he relocated to New York where he worked as a steamfitter and pipe-fitter from 1948-1970s at numerous construction sites and powerhouses. LPK filed this mesothelioma lawsuit in the Supreme Court for the State of New York, located in downtown Manhattan, against the companies responsible for the plaintiff's Asbestos exposure. The multi-million dollar settlement was obtained as the result of litigation against these companies in the New York City Asbestos Litigation (NYCAL), which is a coordinated litigation effort designed to efficiently resolve claims of victims of Asbestos-related diseases including mesothelioma.
In the United States, Asbestos is the only known
, an aggressive form of cancer that occurs mainly in the lining of the lungs and the abdomen. Mesothelioma typically develops at least fifteen years after an individuals first exposure to Asbestos. Asbestos can cause mesothelioma even when the exposure occurs for only a short duration. Asbestos fibers are microscopic and exposure can occur without a worker even knowing it. Mesothelioma occurs not only in people working directly with Asbestos products but also in bystanders and family members exposed to Asbestos dust.
Even though the Pennsylvania Asbestos legal case did not originate in New York, the lawsuit was able to be filed and prosecuted in New York by LPK. Attorneys at LPK have prosecuted mesothelioma lawsuits on behalf of mesothelioma victims in New York and New Jersey for more than twenty-five years.
